Section 1 of Article 31 in the UAW Constitution allows members from different local unions (locals) to file formal charges against a UAW leader for things like misconduct, mismanagement, or violating union principles. Here’s a step-by-step guide to help you understand the process.
Before anything else, the members of your local need to agree that there’s a serious issue with the leader in question. This could be financial mismanagement, breaking union rules, or other misconduct. Make sure there’s solid evidence to back up the claim.
Once your local agrees that there’s a problem, reach out to other locals to gather support. To bring charges, you need 10 different locals from at least 5 states. Here’s how you do it:
Once you have support from at least 10 locals in 5 different states, you’ll need to write the formal charges. This document should clearly state:
Each local must hold a vote where members decide whether or not to support the charges. According to the UAW Constitution, at least two-thirds (2/3) of the members present at the meeting must vote in favor of bringing the charges. If your local gets that level of support, you can move forward with the charges.
Once you have support from at least 10 locals in 5 different states and each local has voted in favor, the next step is submitting the charges to the appropriate UAW body, as outlined in the UAW constitution. The charges must be submitted in a formal, written manner and include:
After the charges are submitted, the UAW leadership will follow a process to review them. This can involve:

[Greeting]
Hello [Regional Director’s Name], this is [Your Name], a UAW member in good standing from [Your Local Union Number/Region]. I hope you're doing well today.
[Introduction]
I wanted to speak with you briefly about some concerns I have regarding the direction our union leadership is currently taking under President Shawn Fain. As a dedicated member, I feel it’s important to address these issues directly with you, given your role and responsibilities as our Regional Director.
[Key Concerns]
There are a few specific issues that are troubling to me and many other members:
[Call to Action]
As outlined in the UAW Constitution, specifically in Article 45, Section 1, it is your duty as a Regional Director to support and advocate for the members within your region. Additionally, Article 31 provides a mechanism for bringing charges when there are concerns about misconduct or violations of ethical standards.
Given the seriousness of these issues, I urge you to consider utilizing Article 31 to hold our leadership accountable and to ensure that our union is led with integrity and a true commitment to our members' best interests.
[Closing]
I appreciate you taking the time to listen to these concerns. It’s important that our leadership truly represents the values and needs of our members. I trust you will take these issues seriously and consider the necessary actions to address them.
Thank you again, [Regional Director’s Name]. I look forward to hearing back from you on how we can move forward together to strengthen our union.
[Goodbye]
Have a great day, and I appreciate your time.
Dear [Regional Director’s Name],
I hope this message finds you well. My name is [Your Name], and I am a UAW member in good standing from [Your Local Union Number/Region].
I am writing to express my deep concerns about the current direction of our union's leadership under President Shawn Fain. As a committed member of the UAW, I believe it is essential that our leadership remains transparent, accountable, and aligned with the values and interests of our membership.
Recent developments have raised significant worries among the membership, including the ongoing investigation by the federal monitor into allegations of corruption within our leadership. This investigation, coupled with reports of an environment that may foster retaliation against those who voice concerns, is troubling and undermines the trust that is vital between the leadership and the members.
Additionally, there are serious concerns regarding staffing and hiring practices, as well as the allocation and spending of union funds. It is critical that these practices reflect the union's commitment to responsible stewardship of our resources and adherence to the highest ethical standards.
According to the UAW Constitution, it is the duty of Regional Directors to support and advocate for the members in their regions, as outlined in Article 45, Section 1. Moreover, Article 31 of the UAW Constitution provides a mechanism for bringing charges against any member, including leaders, who may be violating the ethical standards and responsibilities expected of them. As a Regional Director, you hold the responsibility to ensure that this mechanism is utilized when necessary to protect the integrity of our union.
As these issues continue to persist, it becomes increasingly difficult to support the current leadership, including President Fain’s ongoing tenure or any potential re-election efforts. It is imperative that our union is led by those who are committed to genuine labor experience, ethical practices, and a clear understanding of the needs and challenges faced by our members.
Thank you for your time and attention to this matter. I trust that you will take these concerns seriously and consider the appropriate actions under Article 31, fulfilling your constitutional obligations to work towards a leadership that truly represents the best interests of UAW members.
Sincerely,
[Your Full Name]
[Your Local Union Number/Region]
